1 Acceptance of Terms

By accessing, downloading, installing, or using the Guard Eye mobile application ("App") or the Guard Eye website at www.guardmyphone.com ("Website") (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms.

2 Description of Service

Guard Eye is an Android anti-theft and phone security application designed to help users protect their mobile devices. The Service provides the following core functionality:

• Evidence Capture — Photographs, HD video with audio, and GPS location data captured upon detection of unauthorized access attempts (failed unlock, SIM removal, snatch motion, break-in detection)
• Alert Delivery — Instant email alerts containing captured evidence sent via the Gmail API to the user's configured email address
• Cloud Backup — Automatic upload of evidence files to the user's personal Google Drive account
• Anti-Theft Protection — Snatch detection, commuter shield, fake home screen, app disguise, alarm, shutdown prevention, and other security features
• Meta Glasses Scanner — Bluetooth Low Energy (BLE) scanning to detect nearby Meta Ray-Ban smart glasses

The Service is provided on a freemium model: core protection features are available for free, while advanced features ("Pro Features") require a paid subscription.

3 Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service. By using Guard Eye, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into a binding agreement
• You are not barred from using the Service under any applicable laws
• You will use the Service only on devices that you own or are legally authorized to use

4 Account & Authentication

Guard Eye uses Google Sign-In for authentication. By signing in with your Google account, you authorize Guard Eye to access the Google API Services described in our Privacy Policy, including the Gmail API (to send security alert emails) and the Google Drive API (to upload evidence files).

4.1 Your Responsibilities

• You are responsible for maintaining the security of your Google account credentials
• You are responsible for all activity that occurs through Guard Eye under your account
• You must promptly notify us if you become aware of any unauthorized use of your account
• You may revoke Guard Eye's access to your Google account at any time through your Google Account permissions settings

4.2 Configuration Settings

You are solely responsible for configuring Guard Eye's settings, including trigger sensitivity, evidence types, alert email addresses, and notification preferences. Guard Eye operates based on the settings you configure.

5 License & Usage Rights

5.1 License Grant

Subject to your compliance with these Terms, Guard Eye grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Android devices that you own or control, solely for your personal, non-commercial security purposes.

5.2 License Restrictions

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or reverse-engineer the App
• Decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any proprietary notices or labels on the App
• Use the App for any illegal or unauthorized purpose
• Use the App to monitor or surveil any person without their knowledge or consent, in violation of applicable law
• Use the App on devices you do not own or are not authorized to manage
• Interfere with or disrupt the integrity or performance of the Service

6 Subscriptions & Payments

6.1 Free Features

Guard Eye offers core security features at no cost, including photo capture, email alerts, GPS tracking, alarm, SIM change detection, break-in detection, boot persistence, hidden notifications, custom email subjects, and Meta Glasses scanning.

6.2 Pro Subscription

Advanced features require a Guard Eye Pro subscription. Pro features include snatch detection, commuter shield, fake home screen, app disguise, Google Drive backup, app lock, and shutdown prevention. Pro subscriptions are billed through the Google Play Store.

6.3 Billing & Renewal

• Pro subscriptions are billed on a recurring basis (monthly or annually, as selected at purchase)
• Payment is charged to your Google Play account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Prices may change with reasonable notice; continued use after a price change constitutes acceptance

6.4 Cancellation & Refunds

• You may cancel your Pro subscription at any time through the Google Play Store
• Upon cancellation, you retain access to Pro features until the end of your current billing period
• Refunds are handled in accordance with Google Play's refund policies

7 Acceptable Use Policy

Guard Eye is designed for legitimate personal security purposes — protecting your own devices from theft and unauthorized access. You agree to use the Service only for lawful purposes and in accordance with these Terms.

Violation of this Acceptable Use Policy may result in immediate termination of your access to the Service and may be reported to law enforcement authorities where appropriate.

8 Intellectual Property

8.1 Guard Eye IP

The Service and its original content (excluding user-generated content), features, functionality, branding, logos, and design are and will remain the exclusive property of Guard Eye and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

8.2 Your Content

All evidence captured by Guard Eye (photos, videos, audio, location data) is your content. You retain full ownership of all evidence data. Guard Eye does not claim any ownership or license to your captured evidence. You are solely responsible for how you use, store, share, or distribute your evidence.

8.3 Feedback

If you provide suggestions, ideas, or other feedback about the Service ("Feedback"), you grant Guard Eye a non-exclusive, worldwide, royalty-free, irrevocable license to use, modify, and incorporate such Feedback into the Service without any obligation to you.

9 Third-Party Services

Guard Eye integrates with the following third-party services to provide its core functionality:

• Google Sign-In — For user authentication
• Gmail API — For sending security alert emails from your account
• Google Drive API — For uploading evidence to your cloud storage
• Google Play Billing — For processing Pro subscription payments

Guard Eye is not responsible for the availability, accuracy, content, or policies of third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

10 Disclaimers & Warranties

Guard Eye does not warrant or guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free
• Evidence will be successfully captured, transmitted, or stored in every security event
• The Service will prevent theft, unauthorized access, or loss of your device
• The snatch detection, commuter shield, or other detection features will activate in every real-world scenario
• The Meta Glasses scanner will detect all smart glasses or wearable recording devices
• Email alerts will be delivered successfully in all circumstances (network connectivity, email service availability, and device state may affect delivery)
• Google Drive uploads will complete successfully in all circumstances

Guard Eye is a security tool designed to assist you in protecting your device and gathering evidence. It is not a guarantee of device recovery, personal safety, or crime prevention. You should not rely solely on Guard Eye for your security and should always contact local law enforcement in the event of theft or criminal activity.

11 Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

12 Indemnification

You agree to defend, indemnify, and hold harmless Guard Eye, its developers, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including privacy rights
• Your use, storage, or distribution of evidence captured by Guard Eye
• Any content you submit, post, or share through or in connection with the Service

13 Termination

13.1 Termination by You

You may stop using the Service at any time. To fully terminate your relationship with Guard Eye:

1. Cancel any active Pro subscription through the Google Play Store
2. Revoke Guard Eye's access to your Google account at myaccount.google.com/permissions
3. Uninstall the App from your device(s)

13.2 Termination by Guard Eye

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms, violate the Acceptable Use Policy, or engage in conduct that we determine, in our sole discretion, to be harmful to other users, us, or third parties.

13.3 Effects of Termination

Upon termination, your license to use the Service terminates immediately. Evidence data previously captured and stored on your device, in your Gmail, or in your Google Drive will remain accessible to you. Sections 8, 10, 11, 12, and 15 of these Terms shall survive termination.

14 Changes to Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where feasible, notify users through the App or by email.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

We encourage you to review these Terms periodically to stay informed about the terms governing your use of Guard Eye.

15 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Guard Eye operates, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in the jurisdiction where Guard Eye is registered.
